This is the privacy notice of SleepShack, a website owned by Chris Seton (Sole Trader, ABN 35 655 825 678, registered in Australia). In this document, “we”, “our” or “us” refers to SleepShack, a website owned by Chris Seton.

This notice will inform you about our policy regarding all information that we record about you. It covers both information that could identify you and information that could not.

We are concerned about protecting your privacy and confidentiality. We manage your information in accordance with the National Privacy Principles set out in the Privacy Act 1988 (Cth). Except as set out below, we do not share, or sell, or disclose to a third party, any personally identifiable information collected at this site.

We regret that if there are one or more points below with which you are not happy, your only recourse is to leave our website immediately.

By accessing the website you accept the terms and conditions of its use, including consent to the collection, use and disclosure of your personal information in accordance with this privacy policy.

Basic identification and contact information.

Information such as your name and phone number is used:

to provide you with the services which you request; for verifying your identity for security purposes; information which does not identify any individual may be used in a general way by us, to provide website analysis, for example relating to demographics or usage of a particular website page.

We shall not under any circumstances divulge your name and phone number to any person who is not an employee or contractor of ours and who does not need to know, either generally or specifically.

Your domain name and email address

Your domain name and email address are recognised by our servers and the pages that you visit are recorded. We shall not under any circumstances divulge your email address to any person who is not an employee or contractor of ours and who does not need to know, either generally or specifically. This information is used:

to correspond with you or deal with you as you expect; in a collective way not referable to any particular individual, for the purpose of quality control and improvement of our site; to send you news about the services to which you have signed up; to tell you about new features of our service.

Website usage information

We currently use Google Analytics to collect information about which pages you view and how you reach them, what you do when you visit a page, the length of time you remain on the page, and how we perform in providing content to you. We do not associate such information with an identifiable person.

Financial transaction with your credit card

The financial transaction to purchase the SleepShack service is never taken by us through our website. At the point of payment, you are transferred to a secure page of payment service provider PayPal. That page is accessed from sleepshack.com.au, but PayPal is not controlled by us. Our staff and contractors never have access to your credit card details.

We do not retain your credit card information

We do not keep nor store your credit card number or details. Not retaining your credit card details, also prevents the possibility of our duplicating a transaction without a new instruction from you.

We use Secure Sockets Layer (SSL) certificates to verify our identity to your browser, and to encrypt any data you give us. Our SSL certificate uses strong 256-bit encryption.

Credit reference

To assist in combating fraud, we share information with credit reference agencies so far as it relates to client who instruct their credit card issuer to cancel payment to us without having first provided an acceptable reason to us and given us the opportunity to refund their money.

Collecting your child’s personal information

This includes all information given to us in the course of the SleepShack Program. In undertaking the SleepShack Program, the following personal information will be collected on your child (defined in age from 10 years to 18 years):

name, email address and mobile phone number; data collected from the 4 Screening Questions, used to assess suitability; data collected from the Pre Treatment Questionnaire – 7 Sections; data collected from the Pre Treatment 21 day Sleep Log; data collected from the Post Treatment 42 Day Sleep Log; and if required, data collected from the Post Treatment 28 Day Sleep Log;

In accordance with Regulation 7 of the Medical Practice Regulation 2003 (NSW) for children (less than 18 years old) these records must be kept until the patient attains or has attained the age of 25 years. These records are also kept because we may need it in some way to support a claim or defence in court.

We undertake to preserve the confidentiality of the information and of the terms of our relationship. It is not used for any other purpose. This data will not be shared with third parties.

We expect you to reciprocate this policy.

Purpose of personal information

Your child’s personal information is collected for the following purposes:

to correspond with you and your child or deal with you and your child as you expect; in a collective way not referable to any particular individual, for the purpose of quality control and improvement of our site; to deliver a Sleep Treatment Plan; to undertake clinical research on the effectiveness of the SleepShack Treatment for publicity purposes. In this event you will be asked if you wish to be involved and you can opt out; to tell you about new features of our service.

Cookies

Cookies are small text files that are placed on your computer's hard drive through your web browser when you visit any website. They are widely used to make web sites work more efficiently, as well as to provide information to the owners of the site.

You can manually disable cookies at any time. Check your browser’s ‘Help’ to find out how. Although your browser software enables you to disable cookies, this will not affect your ability to view the site. However we recommend that you allow the use of cookies in order to take advantage of the features of our website that rely on their use. You can still use this website even if you choose to disable cookies.

Using our Contact Us page or providing feedback

When you send an email through our Contact page or provide feedback on the service via a survey tool, we collect the data you have given to us in order to assess and increase the efficiency of our service. We will keep personally identifiable information associated with your message, such as your name or email address.

Complaining

When we receive a complaint, we record all the information you have given to us. We use that information to resolve your complaint. If your complaint reasonably requires us to contact some other person, we may decide to give to that other person some of the information contained in your complaint. We do this as infrequently as possible, but it is a matter for our sole discretion as to whether we do give information, and, if we do, what that information is.

Content you provide to us for publishing purposes

If you provide information to us with a view to it being read, copied, downloaded or used by other people, we accept no responsibility for what that third party may do with it. It is up to you to satisfy yourself about the privacy level of every person who might see your information.

Affiliate information

This is information given to us by you in your capacity as an affiliate of ours. Such information is retained for business use only. We undertake to preserve the confidentiality of the information and of the terms of our relationship. It is not used for any other purpose. We expect any affiliate to agree to reciprocate this policy. As an exception to this, we have the right to disclose your first name and URL of your affiliate connection to other affiliates and to any other person or organisation, on and off site.

Use of site by children

Certain areas of our website are designed for use by children over 10 years of age. These areas include “Questionnaire”, “Sleep Log”, “Treatment Plan” and “Body Clock Plan”.

Such child users will visit other parts of the site and will be subject to whatever information, content and on-site marketing they find.

Disclosure to government and their agencies.

We are subject to the Australian law. We may be required to give information to legal authorities if they so request or if they have the proper authorisation such as a search warrant or court order.

Reviewing & updating your information

At any time you may review or update the personally identifiable information that we hold about you, by contacting us. To better safeguard your information, we will also take reasonable steps to verify your identity before granting access or making corrections to your information.

Our website is hosted in Melbourne, Australia. Accordingly data obtained within Australia may be “processed” outside Australia and data obtained in any other country may be processed within or outside that country.
